DECREE OF THE MINISTER OF INDUSTRY AND TRADE
NO. 649/MPP/KEP/10/2004

CONCERNING
THE APPOITMENT OF SURVEYORS AS EXECUTORS OF VERIFICATION OR TECHNICAL SURVEILLANCE
OF THE IMPORT OF PRECURSOR

THE MINISTER OF INDUSTRY AND TRADE,

Considering:

• a. that in the framework of implementing the provision in Article 12 of Decree of the Minister of Industry and Trade No. 647/MPP/Kep/10/2004 on precursor import prevision, it is necessary to appoint surveyors as executors of verification or technical surveillance of the import of precursor;
• b. that in relation thereto, it is necessary to issue a decree of the Minister of Industry and Trade;

In view of:

• 1. Presidential Decree No. 228/M/2001 on the establishment of the Mutual Cooperation Cabinet;
• 2. Presidential Decree No. 102/2001 on the status, tasks, functions, authority, organizational structures and working arrangements of ministries;
• 3. Presidential Decree No. 109/2001 on first-echelon organizational units and tasks of ministries;
• 4. Decree of the Minister of Industry and Trade No. 86/MPP/Kep/3/2001 on the organization and working arrangement of the Ministry of Industry and Trade;
• 5. Decree of the Minister of Industry and Trade No. 647/MPP/Kep/10/2004 on precursor import provisions;

DECIDES:

To stipulate:

FIRST:

To appoint:

• 1. PT Surveyor Indonesia; and
• 2. PT Superintending Company of Indonesia (PT Persero SUCOFINDO);

As surveyors executing the verification or technical surveillance of the import of precursors.

SECOND:

The surveyors as meant in Dictum FIRST shall have the following tasks:

• 1. undertaking verification or technical surveillance of the import of precursors in accordance with the provisions as contained in Decree of the Minister of Industry and Trade No. 647/MPP/Kep/10/2004 on precursor import provisions;
• 2. issuing Surveyor Report (LS) or Certificate of Inspection (COI) as import document certifying:
• a. clear and full identity (name and address of) exporters and importers;
• b. truth of no. and date of recognition as Producing Importer (IP) or appointment as Registered Importer (IT) and no. as well as date of approval of the import of precursor;
• c. truth of kind of goods, tariff heading/HS no. and Chemical Abstract Services (CAS) of the imported precursor;
• d. truth of composition of chemical substances of precursor;
• e. truth of quantity or volume of precursor;
• f. truth of producing or origin country of precursor; and
• g. truth of quantity of package of precursor.
• 3. Giving mark in the form of label or seal in package of precursor as evidence that the precursor has been verified or surveyed by surveyor.
• 4. Procedures for marking or labeling as meant in point 3 are made and implemented by surveyors in accordance with the standards in force.
• 5. Conveying written report on the implementation of verification or technical surveillance of the import of precursor periodically once every month in the first week of the ensuing month to the Director General of Foreign Trade in this case the Director of Import, Ministry of Industry and Trade.

THIRD:

Survey in the framework of the verification or technical surveillance of the import of precursor as meant in Dictum SECOND point 1 shall be done in country of origin when the precursor is loaded.

FOURTH:

Lateness or other mistakes in the issuance of Surveyor Report attributable to negligence of surveyors, intentionally or not, shall become responsibility of the surveyors in accordance with the provisions in force in the International Federation of Inspection Agency/IFA.

FIFTH:

Based on the implementation of the verification or technical surveillance of precursor, the surveyors can collect compensation for service they render from producing importers or registered importers with amount adjusted to the principle of benefit.

SIXTH:

All costs related to the implementation of this decree shall become responsibility of the surveyors.

SEVENTH:

The appointment of surveyors as meant m Dictum FIRST shall not abolish the authority of the Minister of Industry and Trade to revoke, replace or supplement the appointment of surveyors as executor of survey of import of precursor.

EIGHTH:

Technical provisions related to the implementation of this decree shall be stipulated by a decision of the Director General of Foreign Trade, Ministry of Industry and Trade.

NINTH:

The decree shall come into force as from the date of stipulation.
